Period of validity of planning permits
As is known, the period of validity of planning permits is determined by
based on the article 28 of the Town Planning and Spatial Planning Law, from which
it follows that the Town Planning Authority is possible, at its discretion, to adapt
the duration of the urban planning permit, depending on the specific characteristics
and the requirements of permitted development or the need for town planning
area setting, in which the development is located.

The Ministry of the Interior has found that to date they have not
sufficiently utilize the possibilities provided in the Legislation for its benefit
more general development, of the quality and speed of service provision to
citizens and investors, while at the same time the practice that has been created
Over time, as far as the specific issue is concerned, it seems to be getting more difficult, instead of
facilitates and accelerates the procedures for exercising urban planning control.
Additionally, the Town Planning Authorities, but also applicants often suffer from
procedures for submitting and examining a new application for a planning permit to
cases where this permit expires before a building permit can be issued,
or because of the long time required for the completion of the construction
control, or due to the delay in submitting an application for a building permit with
responsibility of the applicant, or for other reasons. In many of these cases
additional complications arise from the express provision of the legislation, that the
extension of a granted planning permit is possible only when the development
has actually begun and is legally in active execution.

The above cases contribute significantly to the waste of their time
Urban Planning Authorities and create very serious problems in implementation
development projects in a legal and rational manner.

The above findings, as well as his more general and continuous effort

In case of granted planning permission, which is about to expire, or
The Town Planning Authority will accept an application for the modification of the term which
it is typically included in all planning permits and concerns the period
validity of the license. Specifically, the Urban Planning Authority will approve its extension
period of validity of the license for one year or for an additional period of time,
if this becomes necessary, provided that the Building Authority
certifies that an application for a building permit has been submitted for a longer period
of one year from the expiry of the urban planning permit and its non-completion
study of the application is not due to the applicant. Analogous expansion can
approved even when the above condition is not met, provided that
in the period from the granting of the license to the submission of the application for
modification of the above condition, its provisions have not been varied
of the Development Plan that were in force at the time the license was granted, for ownership
of development.
In case of expiry of the period of validity of the urban planning permit, the applicant is
possible to submit a new application with the plans sealed by the
Planning Authority as part of the expired permit, with which he will request the
re-granting of the expired urban planning permit. In such a case, or
Urban Planning Authority, after conducting a quick and concise check to
confirm that the urban planning and development status of the property does not
has diversified in the interim, it is possible to grant news
planning permission with the re-stamping of copies of the plans and
terms of the expired urban planning permit. In case the intended
development is different from that for which the license had been granted which
expired, the conventional procedure will be followed.
PLANNING PERMITS GRANTED AFTER ITS MARKETING
THIS CIRCULAR LETTER

Planning permission granted after the circulation of this Circular
letter for development on an approved or registered plot, independently
by the type of development, will have a validity period of six years.

Planning permission granted after the circulation of this Circular
of letter for development on properties other than those mentioned in (c) more
above, condition will be set, under which the period of validity of the license shall
may be extended by summary procedure by one year beyond the period
of force specified in the urban planning permit, in case it is submitted
to the Building Authority an application for a building permit within a period of one year
from the granting of the urban planning permit and the delay in its examination
said application is not due to the applicant.
As of the receipt of this notice, Circular no. 3/2006 and
is replaced by the present one.
