The Minister of the Interior, exercising the powers conferred on him by the articles 5 and 17 of about
City Planning and Spatial Planning Law, issues the following Decree.
Summary
title.
1. This Ordinance will be referred to as the Urban Planning and Spatial Planning Ordinance (Assignment
Powers) His decree 2024, and replaces Decree no. KDP 216/2024 where
was published on 21/6/2024.

2. In this Decree:
"Director" means the Director of the Department of Town Planning and Housing.
"Provincial Self-Governing Organisation" means the body established on the basis of
the article 3(1) of the Laws on Provincial Self-Governing Organizations 2022 up to him
2024, or any other law amending or superseding them.
"Officer" means the Officer of the District Self-Government Organization who
defined in accordance with paragraph 5.
"Law" means its Town Planning and Zoning Laws 1972 up to him 2021 or
any other Law amending or replacing them.
"Town Planning Council" means the Council provided for in the Regulation 3 of about
of Town Planning and Spatial Planning (Town Planning Council) Regulations of 1973 and his 2003.
"Council" means the Council referred to in art 5 of about Provincials
Laws of Self-Governing Organizations 2022 up to him 2024, or any other law which
modifies or replaces them, and

3. The Minister revokes the precedent on Town Planning and Spatial Planning (Assignment
Powers) Ordinance and confers certain of the powers conferred upon him by Act v
defined in the following paragraphs, and as described in his Tables
of this Decree.

4. The Minister assigns to the Town Planning Council all the responsibilities provided to him-
(a) The articles 10, 11 and 12 of the Law, regarding the overview of any area
and the preparation of a Local Plan for this area.
(b) the article 13 of the Law, regarding the preparation of an Area Plan
(c) the articles 14 and 15 of the Law, regarding the revision and amendment of Local
of Plans and Area Plans.
(d) the article 16 of the Law, regarding the requirement to prepare and submit Local
Plans and Area Plans and the submission of proposals, with respect to amendments or
submitting proposals, regarding amendments or additions to a Local Plan or
Area Plan.
(e) the article 85(3) of the Law, regarding plan approval issued pursuant to
the article 12 of the Regulation of Roads and Buildings Law:
It is understood that any Plan prepared or revised or amended based on the provisions
of the articles 10 until 16 submitted to the Minister in accordance with the article 17 of the Law.

5. –(1) With the exception of verses (1), (2), (3), (5) and (6) of the article 22 and the articles 18, 18A, 23,
24(1), 30, 33, 35, 38, 39, 40, 41 and 47 of the Law and the cases mentioned
in the first column of Table A, and for the cases described in the Table
B, of this Decree, the Minister assigns to it the powers it has as Urban Planning
Authority for planning control and enforcement of planning control, as defined in
Fifth and Sixth Part of the Law and the conclusion of an agreement, as defined in
article 82 of the Law, of the Officers of the Provincial Self-Government Organizations, where
defined by his letter.
(2) The authority of the Officers in relation to the article 36 of the Law on revocation of urban planning
license is exercised only with the consent of the Council or Committee that has been established
by decision of the Council for the purposes of this Decree.
Provided that for developments carried out by the Provincial Organizations
Self-government on behalf of immovable property belonging to the Organisations, or to
state land leased to her, or in an open public space/ square in its administrative areas
limits, the relevant Provincial Self-Government Organization will send to the Minister for
views notice of proposed development with all relevant documents. If o
Minister does not express opinions in period 45 days after receiving the notice,
then it is assumed that he does not wish to express an opinion.

6.–(1) With the exception of verses (1), (2), (3), (5) and (6) of the article 22 and the articles 18, 18A, 23,
24(1), 30, 33, 35, 38, 39, 40, 41 and 47 of the Law and the cases mentioned
in the second and third columns of Table A, and for the cases described in
Table B, of this Decree, the Minister delegates to the Director the powers which
has as a Town Planning Authority for town planning control and enforcement of town planning control,
as defined in the Fifth and Sixth Parts of the Law and to conclude an agreement,
as defined in the article 82 of the Law.

(2) The Minister assigns his powers as Town Planning Authority for all town planning
applications that will be pending on 1/7/2024, which based on this Decree
are now the responsibility of the Officers of the Provincial Organizations
Self-government, while before the publication of this Decree they constituted
competence of the Director, to the Officers of the Provincial Organizations
Self-government, except in the following cases, that the responsibility remains with
Director:
(a) For all applications submitted before 1/7/2023.
(b) Any required Environmental Opinion has been secured for those applications-
donation or Reasoned Finding up to 1/7/2024, regardless of her
date of their submission.

7.–(1) The Town Planning Authority to which is assigned the power to exercise town planning control,
in accordance with the provisions in the paragraphs 5 and 6 above, shall exercise this power
and in relation to a development or aspect of development for which a special policy is established
discretion in the current Development Plan, only after previously securing
the views of the Local Administration Authority.
(2) When the Local Administration Authority does not communicate its opinion to the Town Planning Authority
within a period 21 days from the receipt of the relevant consultation, then it will be considered
that it agrees with the recommendation of the Urban Planning Authority, or that he does not wish to articulate
view, unless a reasonable extension of this period is requested in writing and justified.

8. In cases of land separation or development involving the creation of a road
of network in a block which abuts on or is located on a road of primary importance
distance less than 150 meters from such a road, the Town Planning Authority, which
defined on the basis of para 5 of this Decree, exercise that power alone
after securing in advance the views of the Director, in the cases where:
i. the primary road has not materialized
ii. construction plans for the priority road have not been approved
iii. in any other case the access of the piece is not known and/or
its influence from the road of primary importance.

9.–(1) The Council or any Committee established by resolution of the Council for
purposes of this Decree, can, in case of any urban planning
application where it is assessed that serious issues of an environmental nature arise, for
development for which the preparation of an Impact Assessment Study is required on
Environment or Information Report based on the Impact Assessment on
Environment by Certain Acts, to request the Town Planning Authority in which
authority to exercise urban planning control is granted in accordance with the provisions of
paragraph 5 above, the referral of the application to him/her, for filing the claims
his/her opinions before the Town Planning Authority takes a decision, for which the
Council or Commission should be informed again.
(2) In the event that the Council or Committee does not give his/her consent for the
specific handling of the Town Planning Authority, will send the application to Town Planning
Authority to review and reinstate it/or, and the Council/Committee is established
competent to make a final decision regarding the application.

10.–(1) The Town Planning Authority to which is assigned the power to exercise town planning control,
in accordance with the provisions of the paragraph 5 above, shall exercise this power in relation
with the following, after first obtaining the consent of the Council or her
Commission for handling:
(a) In relation to an application for which substantiated adverse views have been expressed by
the Local Administration Authority, and/or organized sets.
(b) In relation to an application to which an Incentive Scheme or special provision applies
Development Plan to increase the building factor.
(2) In case the Council or the Commission does not give his/her consent for the
specific handling of the Town Planning Authority, will send the application to Town Planning
Authority to review and reinstate it/or, and the Council or Commission becomes
competent to make a final decision regarding the application.

11. For the following categories of deployments, the Town Planning Authority to which it is hereby assigned-
with the exercise of urban control in accordance with the provisions of the paragraph 5 of
Decree, shall exercise this power, on the basis and according to the relevant
Council guidelines, which will be consistent with the General Strategy
Development of the Development Plans and with its relevant circular guidelines
Minister of the Interior, as the paragraph 14 of the Decree. Additional, in each
case, the guidelines of the Council should be approved by the
Minister of the Interior.
(a) Construction of an individual residence outside the Development Limit.
(b) Other use within a Residential Zone (excluding roadside applications
of primary importance).
(c) Construction of a petrol station.

12. The Town Planning Authorities defined based on the paragraphs 5 and 6 above submit-
receive monthly comprehensive information from the Minister of the Interior regarding
results of the exercise of their powers and responsibilities hereunder

13. The Town Planning Authorities defined based on the paragraphs 5 and 6 above comp-
they are bimonthly and/or where this is deemed necessary within a shorter period of time,
under the coordination of the Director with the aim of ensuring consistent and coordinated
implementation of the Law and the exercise of the powers delegated by the Minister with
based on this Decree.
It is understood that the Director, within the framework of his responsibilities as Coordinator of
Town Planning Authorities, and authorized by the Minister of the Interior, may
issues Circulars to all Town Planning Authorities for faithful implementation.

14. The Minister of the Interior, as a Town Planning Authority based on the article 4 of the Law, sends
Urban Planning Policy Circulars and Directives, to ensure smoothness
transfer of responsibilities and the orderly operation of the Provincial Organizations
Self-Government as Town Planning Authorities, for its effective management and performance
development control system, as well as for purposes of achieving the strategies
goals of the state in the field of development and the environment.
