Assessment of planning applications in single residential developments, with
application of the provisions of the article 90 of Urban Planning and Spatial Planning
Law (Law 90/1972)
Following the instructions of the competent Ministerial Committee for the examination of Hierarchies
Appeals, which are submitted based on the article 31 of Urban Planning and
Zoning Law (Law 90/1972), the Departments of Urban Planning and Housing and
of Cadastre and Land Surveying evaluated ways to deal with the difficulties
which arose due to the strictness in the application of the current legal
framework and the relevant clarifications, contained in a letter from the Department
of Land Registry and Spatial Survey with no. lens. K.X.T. 5.19.1.2 and date
03.01.2019, concerning the need to secure the signatures of all
co-owners in cases of applications for urban planning permission for
additions/ conversions to single residential developments.
2. Recognizing both the problems that arise in the aforementioned
cases, in relation to licensing but also the modernization of registration
developments, as well as the need to preserve the comforts as well as the

τροποποίηση του σχετικού νομικού πλαισίου και συγκεκριμένα του άρθρου 90(1)(c) of
on Town Planning and Spatial Planning Law (Law 90/1972) και του άρθρου 38∆ του περί
Ακίνητης Ιδιοκτησίας (∆ιακατοχή, Registration and Evaluation) Law (Κεφ.224).
3. Με την παρούσα Εγκύκλιο και μέχρι την προαναφερόμενη τροποποίηση του
σχετικού νομικού πλαισίου, οι Πολεοδομικές Αρχές είναι δυνατόν να αξιολογούν
αιτήσεις σε κοινόκτητα τμήματα σε περιπτώσεις ενιαίων οικιστικών αναπτύξεων, with
application of the provisions of the article 90(1)(c), με τις ακόλουθες προϋποθέσεις:

Η αίτηση αφορά ή και συμπεριλαμβάνει ανάπτυξη σε περιορισμένη κοινόκτητη
property, which was allocated to a unit for exclusive use, and
signed by the registered owner or beneficiary of the unit to
benefit of which the exclusive right is registered, without her
presenting the consent or approval of the co-owners in the joint property
building.

Regardless of the provisions of Real Estate (∆ιακατοχή, Recording
and Assessment) Law (Κεφ.224) and from the provisions of any other law,
the master of each unit can make conversions, additions or
repairs and in the area that has been classified as limited common property
property, allocated to this unit for exclusive use, which
specifically described in the unit registration, provided that it has been granted
relevant permit from the competent Town Planning Authority.
Before granting a planning permit based on the article 90(1)(c) of
Law 90/1972, the Planning Authority shall ensure that the proposed development does not
affects in any way the amenity and development rights of
co-owners and consistent with the provisions of the relevant Development Plan and
Regulations.
Regarding the use of additional Construction Factor for purposes
development on limited common property (exclusive right
of use), this only concerns the Construction Factor which comes from the
utilization of Town Planning Incentives/Measures/Plans based on relevant
decisions of the Council of Ministers and not the Construction Coefficient which
derives from any future upgrade of its Urban Development Zone
real estate, which belongs indivisible to all their masters
units, and for the exploitation of which his consent is required 100%
of the co-owners.
4. This Circular comes into immediate effect.
