<p><strong><u>Amendment of Order 4/2024 according to the article 6 of the Law</u></strong></p>
<p><strong>A. Construction Factor Calculation, Coverage Rate,<br />
Number of Floors and Height of Buildings</strong></p>
<p>B. Building Distances from Property Boundaries</p>
<p>The Home Secretary in the exercise of the powers conferred on him, with<br />
based on the article 6 of the Town Planning and Spatial Planning Law, and for purposes<br />
strengthening the ability to protect the population in the event of a disaster or<br />
enemy attack, amended Order no. 4 of 2024, as follows:</p>
<p>(a) By adding at the end of subpara 2.2.1 (l) of the phrase<br />
«(the relevant subparagraph 2.7)» and,</p>
<p>(b) By adding a new subsection with no. 2.7 as follows:</p>
<p><strong>&quot;2.7 CIVIL DEFENSE SHELTER- </strong>In new developments concerning<br />
construction of an apartment building with a basement, part of the basement area, such as<br />
this will be indicated by Mass Defense, will be categorized as<br />
shelter for use in an emergency. In said space will<br />
provision must be made for water supply, as well as suitable space<br />

from the article 3 of Civil Defense Laws 2002 έως 2024,<br />

3. The Regulation 3 of the basic regulations is amended as follows:<br />
(a) By substituting in para (1) of the text beginning with the words<br />
&quot;for every&quot; (forefront) and ends with the word &quot;includes&quot; (Tuesday<br />
line) with the following text:<br />
«3.-(1) For any electrical or mechanical installation that concerns an application<br />
to the competent authority for the issuance of a building permit for new buildings or an application for<br />
conversion, addition or repair to existing buildings which<br />
covered by a relevant licence, in which a new unit is created, or,<br />
regardless of the above, if this is required at the discretion of the competent authority<br />
principle, a study is submitted to the competent authority, as the case may be,<br />
electrical or mechanical installation, which includes&#039;;<br />
(b) by replacing the semicolon at the end of the subparagraph (e)<br />
of the paragraph (1) with the semicolon and addition, right after,<br />
of the following new subparagraph:<br />
«(f) in the case of a technical building system, the total energy<br />
his performance, specifications for proper installation and calculations<br />
for proper sizing.&#039;&#039;; and<br />
(c) with the addition, immediately after the paragraph (7), of the following news<br />
paragraphs:<br />

			<p>The modification has been published (modernization) των Κανονισμών για τις ηλεκτρομηχανολογικές εγκαταστάσεις στις οικοδομές.<br />
12 Μαρτίου 2026<br />
At 11.03.2026 the KDP Regulations were published in the official gazette of the Republic 129 of 2026 which amend and essentially modernize the Regulations on Roads and Buildings (Mechanical and Electrical Installations) Regulations. The modernization of the Regulations was a constant request of ETEK, εδώ και αρκετά χρόνια.<br />
In summary with the amendment of the Regulations :<br />
(a) the submission of a mechanical installation study for heating and cooling systems is defined as mandatory, without exceptions<br />
(b) mandatory supervision of electromechanical installations is established<br />
(c) the possibility of submitting an electromechanical study is linked to the obligation to register in the register of designers and supervising engineers of ETEK, when this is activated<br />
The preparation of a mechanical study is mandatory for all developments:<br />
More detailed, with the modernization of the Regulations, the submission of an application for a building permit for new developments will require the submission of a mechanical installation study for the heating and cooling system, without the exceptions included in its regulations 2006. also, following a request from the Ministry of Energy, in the context of improving the energy efficiency of buildings, the submission of a mechanical installation study will be required for hot water production systems for domestic use as well as for other specialized technical systems, εάν υπάρχουν.<br />
Supervision of electromechanical installations:<br />
With the new Regulations it is also determined that the mechanical and electrical installations of a building will be supervised by the mechanical engineer or electrical engineer who prepared the relevant study, thereby guaranteeing the statutory supervision of electromechanical installations. In particular, the new Regulations provide that the owner designates the designer of the electrical or mechanical installation to supervise the implementation of his design and, in case a replacement is required, the owner must appoint a replacement of the same profession. In this context, it is determined that upon completion of the works, a certificate must be submitted that the mechanical or electrical installation has been implemented in accordance with the study and the conditions of the building permit or, in the event that changes or additions have been made to the facility in relation to the study and the conditions of the building permit, ότι αυτές έγιναν με έγκριση του προσώπου που επέβλεπε.<br />

Activation of the Register of Researchers for both Electrical and Mechanical engineers:<br />
End, with the amendment of the Regulation, it is determined that the electrical and mechanical engineers who submit studies under the regulation of roads and buildings must be registered in the Register of Surveyors and Supervising Engineers of the ETEK, when this is activated. It is noted that the institutional framework for the Register of Scholars defined criteria and requirements for initial registration in the register (B.C. maintaining appropriate professional liability insurance, initial training in matters related to research services, targeting and improving coc practice) που δημιουργούν τις προϋποθέσεις για αναβάθμιση του ρόλου των μελετητών.<br />
The publication of the aforementioned Regulations is a very important event for ETEK, professional researchers and for the construction industry more broadly. To get to today&#039;s historic moment required patient and methodical effort, the investment of many man-hours and the assistance of many colleagues, η οποία κορυφώθηκε μετά την ολοκλήρωση του νομοτεχνικού ελέγχου των Κανονισμών περί τα τέλη του 2025.<br />
Significant contribution to the consideration of the Regulations during the current parliamentary term and to the productive debate and further improvements made to the Regulations, had the President of the competent Parliamentary Committee Aristos Damianou and the members of the Parliamentary Committee on the Interior, whom ETEK also publicly thanks. Αξιολόγηση πολεοδομικών αιτήσεων σε ενιαίες οικιστικές αναπτύξεις, with<br />
εφαρμογή των προνοιών του άρθρου 90 of Urban Planning and Spatial Planning<br />
Law (Ν.90/1972)<br />
Μετά από οδηγίες της αρμόδιας Υπουργικής Επιτροπής για εξέταση Ιεραρχικών<br />
Προσφυγών, που υποβάλλονται με βάση το άρθρο 31 of Urban Planning and<br />
Zoning Law (Ν.90/1972), τα Τμήματα Πολεοδομίας και Οικήσεως και<br />
Κτηματολογίου και Χωρομετρίας αξιολόγησαν τρόπους αντιμετώπισης των δυσχερειών<br />
που προέκυψαν λόγω της αυστηρότητας στην εφαρμογή του ισχύοντος νομικού<br />
πλαισίου και των σχετικών διευκρινίσεων, που περιέχονται σε επιστολή του Τμήματος<br />
Κτηματολογίου και Χωρομετρίας με αρ. lens. Κ.Χ.Τ. 5.19.1.2 and date<br />
03.01.2019, που αφορούν στην ανάγκη εξασφάλισης των υπογραφών όλων των<br />
συνιδιοκτητών σε περιπτώσεις αιτήσεων για χορήγηση πολεοδομικής άδειας για<br />
προσθήκες/ μετατροπές σε ενιαίες οικιστικές αναπτύξεις.<br />
2. Αναγνωρίζοντας τόσο τα προβλήματα που προκύπτουν στις προαναφερόμενες<br />
cases, σε σχέση με την αδειοδότηση αλλά και τον εκσυγχρονισμό της εγγραφής<br />
αναπτύξεων, όσο και την ανάγκη διαφύλαξης των ανέσεων καθώς και των<br />
ιδιοκτησιακών/αναπτυξιακών δικαιωμάτων των συνιδιοκτητών, προωθείται η<br />
τροποποίηση του σχετικού νομικού πλαισίου και συγκεκριμένα του άρθρου 90(1)(c) of<br />
on Town Planning and Spatial Planning Law (Ν.90/1972) και του άρθρου 38∆ του περί<br />
Ακίνητης Ιδιοκτησίας (∆ιακατοχή, Registration and Evaluation) Law (Κεφ.224).<br />
3. Με την παρούσα Εγκύκλιο και μέχρι την προαναφερόμενη τροποποίηση του<br />
σχετικού νομικού πλαισίου, οι Πολεοδομικές Αρχές είναι δυνατόν να αξιολογούν<br />
αιτήσεις σε κοινόκτητα τμήματα σε περιπτώσεις ενιαίων οικιστικών αναπτύξεων, with<br />
εφαρμογή των προνοιών του άρθρου 90(1)(c), με τις ακόλουθες προϋποθέσεις:<br />
(a)<br />
Η αίτηση αφορά ή και συμπεριλαμβάνει ανάπτυξη σε περιορισμένη κοινόκτητη<br />
ιδιοκτησία, η οποία παραχωρήθηκε σε μονάδα για αποκλειστική χρήση, and<br />
υπογράφεται από τον εγγεγραμμένο ιδιοκτήτη ή δικαιούχο της μονάδας προς<br />
όφελος της οποίας είναι εγγεγραμμένο το αποκλειστικό δικαίωμα, without her<br />
προσκόμιση συγκατάθεσης ή έγκρισης των συνιδιοκτητών στην κοινόκτητη<br />
οικοδομή.<br />

Ανεξάρτητα από τις διατάξεις του περί Ακίνητης Ιδιοκτησίας (∆ιακατοχή, Εγγραφή<br />
και Εκτίμηση) Law (Κεφ.224) και από τις διατάξεις οποιουδήποτε άλλου νόμου,<br />
ο κύριος κάθε μονάδας μπορεί να προβεί σε μετατροπές, προσθήκες ή<br />
επιδιορθώσεις και στο χώρο που έχει χαρακτηρισθεί ως περιορισμένη κοινόκτητη<br />
ιδιοκτησία, που παραχωρήθηκε στη μονάδα αυτή για αποκλειστική χρήση, which<br />
περιγράφεται ειδικά στην εγγραφή της μονάδας, νοουμένου ότι έχει παραχωρηθεί<br />
σχετική άδεια από την αρμόδια Πολεοδομική Αρχή.<br />
Πριν από την χορήγηση πολεοδομικής άδειας με βάση το άρθρο 90(1)(c) of<br />
Ν.90/1972, η Πολεοδομική Αρχή θα διασφαλίζει ότι η προτεινόμενη ανάπτυξη δεν<br />
επηρεάζει με οποιονδήποτε τρόπο τις ανέσεις και τα αναπτυξιακά δικαιώματα των<br />
συνιδιοκτητών και συνάδει με τις πρόνοιες του οικείου Σχεδίου Ανάπτυξης και των<br />
Κανονισμών.<br />
Όσον αφορά τη χρήση επιπρόσθετου Συντελεστή ∆όμησης για σκοπούς<br />
ανάπτυξης επί περιορισμένης κοινόκτητης ιδιοκτησίας (αποκλειστικό δικαίωμα<br />
χρήσης), αυτός αφορά μόνο Συντελεστή ∆όμησης ο οποίος προέρχεται από την<br />
αξιοποίηση Πολεοδομικών Κινήτρων/ Μέτρων/ Σχεδίων με βάση σχετικές<br />
αποφάσεις του Υπουργικού Συμβουλίου και όχι τον Συντελεστή ∆όμησης που<br />
απορρέει από τυχόν μελλοντική αναβάθμιση της Πολεοδομικής Ζώνης της<br />
real estate, ο οποίος ανήκει εξ αδιαιρέτου σε όλους τους κυρίους των<br />
units, και για την αξιοποίηση του οποίου απαιτείται η συγκατάθεση του 100%<br />
των συνιδιοκτητών.<br />
4. Η παρούσα Εγκύκλιος τίθεται σε άμεση εφαρμογή.<br />

Appendix III (Regulation 61 HA) – ΚΔΠ 262/2018<br />
Visitable parts of the buildings by people with disabilities<br />
I am referring to the above issue and given that this has concerned against<br />
many times from the Authorities, that issue Planning Permits and/or Permits<br />
Construction, I wish to inform you, that the subject in question was extensively considered by<br />
the Accessibility Advisory Committee, which recently has<br />
held a special session and has taken a decision as to the wording and the<br />
explanatory text content, by which its relative provisions are explained<br />
Annex III, of Regulation 61HA and which concern access to<br />
ceilings (rooftops) των οικοδομών από άτομα με αναπηρία.<br />
2. Specifically, about the paragraphs 1.12 and 2.1 of Annex III thereof<br />
Regulation 61HA, the Accessibility Advisory Committee concluded the following<br />
conclusions, which are included in the explanatory text, which he has issued<br />

from here on out, to be taken into account by all issuing Authorities<br />
Planning Permits and/or Building Permits:<br />
a) When the ceiling (terrace) of a building is used exclusively for use<br />
electromechanical and similar installations, the elevator is not<br />
necessary to have access to it, μέσω του ανελκυστήρα.<br />
b) When the ceiling (terrace) of a building has an approved use, as jointly owned or<br />
common area, for recreational purposes of all owners/laws<br />
building users, then the lift must go up to the roof<br />
(terrace). By the term recreation we mean the use of a swimming pool, garden, grill,<br />
outdoor seating area and/or yard, for all owners/legal<br />
users. also, the lift must go up to the roof (terrace) and<br />
in the case where there are warehouses for their exclusive use<br />

c) When the recreation area on the roof (terrace) is an exclusive right<br />
of use by one or more owners/legal users of building units,<br />

d) Of course, that in the case of a building that has been declared a listed building,<br />
ancient monument or located in an Area of ​​Special Character or in a Controlled Area<br />

This Clarification concerns the interpretation of the paragraphs 4.1 and 4.5 του Κεφαλαίου 4<br />
(Buildings used as residences) of Annex III of Regulation 61HA,<br />
ειδικά σε ότι αφορά τους απαιτούμενους χώρους στάθμευσης για άτομα με αναπηρία.<br />
A. In the paragraph 4.1 it is stated that :<br />
&quot;4.1 The requirements for buildings used as residences apply<br />
only in apartment buildings with five or more residential units<br />
including those on the ground floor.&quot;<br />
It is obvious from the above paragraph that, where the development is residential with<br />
less than five units, none of the above is required<br />
Appendix III, δηλαδή ούτε και επιπρόσθετοι χώροι στάθμευσης για άτομα με αναπηρία.<br />
B. In the paragraph 4.5 it is stated that :<br />
«4.5 Σε πολυκατοικίες οικιστικών μονάδων απαιτείται ένας χώρος στάθμευσης ανά 15<br />
apartments which is configured in addition to the parking spaces<br />
apartments.&quot;<br />
In relation to the paragraph 4.5 a question was raised as to whether the requirements for spaces<br />
disabled parking apply for beyond 5 οικιστικών μονάδων ή για πέραν των 15<br />
διαμερισμάτων.<br />
The Accessibility Advisory Committee interprets that, in deployments with five or<br />
more residential apartments, an additional parking space is required<br />
persons with disabilities for every fifteen apartments, with a minimum number of one space<br />
disabled parking. Of course that, the final number of additional spaces<br />
disabled parking, is the result of division (number of dwellings<br />

Διευκρίνιση με αριθμό 3<br />
This Clarification concerns the interpretation of the paragraphs 4.9, 4.10 and 4.21 of<br />
Capital 4 (Buildings used as residences) of Annex III thereof<br />
Regulation 61HA, in relation to the width of the staircase and the requirements for them<br />
χώρους υγιεινής.<br />
A. In the paragraph 4.9 it is stated that :<br />
&quot;4.9 The requirements of paragraphs apply 3.53 – 3.69»<br />
In relation to the paragraph 4.9, a question was raised as to whether the reference is wrong<br />
in the paragraphs 3.53 &#8211; 3.69 and especially in the paragraph 3.63 which determines the minimum<br />
required stair width, considering that the specific<br />
paragraphs are included in the chapter concerning buildings that are not used as<br />
κατοικίες.<br />
In this regard, it is clarified that the reference is made correctly : the requirements in paragraphs<br />
3.53 &#8211; 3.69 they apply to both residential and non-residential buildings, since they are the<br />
ελάχιστες απαιτήσεις προς ικανοποίηση της προσβασιμότητας και ασφάλειας στην χρήση.<br />
Consequently, the minimum structural stair width in residential and non-residential buildings<br />
buildings, for the purposes of meeting these requirements it is 1.20 m, and the minimum<br />
width between handrails is 1,00 m.<br />
B. In the paragraph 4.10 it is stated that :<br />
&quot;4.10 Stairways must comply with Regulation 61IA for the<br />
Fire protection.&quot;<br />
In relation to the paragraph 4.10 it was reported to the Advisory Committee that, with<br />
based on the paragraphs 7.125 and 7.131 of Regulation 61IA but also its recommendation<br />
Fire Service, &quot;the common staircase must be at least wide<br />
1100mm».<br />
In this regard, it is clarified that, in the event that there is only one staircase in<br />
building, must be satisfied, at the same time, both the minimum requirements<br />
accessibility (1,20m) as well as the minimum fire protection requirements. In such<br />

case, the minimum stair width that satisfies both requirements is<br />
το 1,20μ.<br />
C. In the paragraph 4.21 the minimum requirements for sanitary facilities are defined<br />
in residential apartments with an area beyond 50 sq. and are given indicatively<br />
παραδείγματα.<br />
In relation to this paragraph it is clarified that, in the sanitary areas of apartments,<br />

equipment. In case such an apartment is intended to be used permanently<br />
by a person with a disability, that person will be able to shape him<br />
specific space, according to his own needs, but without requiring the<br />
